OFFICIAL RULES, TERMS & CONDITIONS AND PRIVACY POLICY
NO SUBSCRIPTION OR PURCHASE REQUIRED TO ENTER OR TO RECEIVE A PRIZE. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. These Official Rules apply for the #MyVDayWish Challenge! sponsored by ADORE ME (“Sponsor”). The Challenge will start at 12:00:00 AM Eastern Standard Time (“EST”) on February 7, 2022 and will end at 11:59:59 PM EST on February 13, 2022. By entering this Challenge, you agree to the Terms in these Official Rules.
CHALLENGE ENTRANTS AND PRIZE RECIPIENT MUST BE BOTH (A) LEGAL RESIDENTS OF ONE (1) OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA, AND (B) AGED 18 YEARS OR OLDER AT THE TIME OF ENTRY TO BE ELIGIBLE. VOID OUTSIDE THE UNITED STATES AND DISTRICT OF COLUMBIA, AND WHERE PROHIBITED BY LAW. Challenge SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. Employees of Sponsor, and its respective parent companies, subsidiaries, affiliates, divisions, advertising and promotion, fulfillment and/or judging agencies (collectively, “Released Entities”), and their immediate families are not eligible. THIS CHALLENGE IS NOT SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM.
1. HOW TO ENTER: Complete the following steps to enter the Challenge:
(i) follow AdoreMe on Instagram (@AdoreMe) or/and TikTok (@adoreme); and
(ii) use the hashtag #MyVDayWish and share a video on Instagram and/or TikTok about what you really want for Valentine’s Day. Entrants will be contacted via DM on Instagram or TikTok (depending on method of entry). Use of automated devices is not valid for entry. Limit one entry per user on Instagram and TikTok. Sponsor is not responsible for lost, late, incomplete, misaddressed, or otherwise misdirected entries that are processed late or incorrectly or are lost due to computer or electronic malfunction, Instagram platform changes or malfunction, or other error. Incomplete, unreadable, inaccurate, unintelligible or late entries which otherwise do not comply with these Official Rules will be disqualified. Your entry constitutes your consent to participate in this Challenge and your consent for Sponsor to administer this Challenge and for other uses as permitted by applicable law. Entries are the property of the Sponsor and will not be acknowledged or returned.
2. WINNER SELECTION/RANDOM DRAWING: One (1) Grand Prize Winner will be selected in a random drawing from among all eligible entries received on Instagram and TikTok and two (2) Additional Prize Winners that will be selected in a random drawing from among all eligible entries received on Instagram and TikTok. The random drawings will be conducted on or about February 14, 2022 by ADORE ME whose decisions are final and binding in all respects pertaining to this Challenge. Odds of winning depend on the number of eligible entries received.
3. PRIZES: The Grand Prize Winner (hereinafter, “Winner”) will be selected at random and awarded a $3000 in Cash or AdoreMe.com Gift Card worth up to $3000. The Additional Prize Winners (hereinafter, “Winner”) will be selected at random and awarded a $1000 in Cash or AdoreMe.com Gift Card worth up to $1000. If any Winner becomes disabled or cannot otherwise fully enjoy the Challenge prize due to illness, Sponsor shall have the option at its sole discretion of: (1) being relieved of liability for fulfillment of the prize award or any part thereof; (2) extending the period during which such prize may be awarded for a period equal to the duration of selected Winner’s disability or illness. Selected Winner must prove such disability by a doctor’s certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and selected Winner at selected Winner’s expense.
4. CLAIMING PRIZE/RELEASE: Eligibility, age and claims made by each potential Winner is subject to verification. Each potential Winner will be notified by DM on or about February 15, 2022, and, provided Winner provides required information, sent via U.S. Mail and/or e-mail an affidavit of eligibility and a liability and publicity release (unless prohibited by law), which each potential Winner must sign and return to Sponsor within ten (10) business days of notification. If a Winner’s notification or prize is returned as undeliverable, or a Winner does not provide an email or mailing address, selected potential Winner is ineligible, or selected potential Winner declines the prize, their Grand Prize and Additional Prizes will be awarded to an alternate potential Winner in a random drawing from among all remaining eligible entries. Sponsor is not responsible for fraudulent e-mails made to entrants not by the Sponsor. Each Winner must supply Sponsor with his/her social security number for tax purposes. Each Grand Prize and Additional Prizes will be awarded provided each is properly claimed.
5. INTERNET: If for any reason this Challenge is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor or Instagram which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Challenge, the Sponsor reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Challenge. The Sponsor does not assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Neither the Sponsor nor any Released Entity is responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Challenge or downloading any materials in this Challenge. SPONSOR IS NOT RESPONSIBLE FOR INCOMPATIBILITY OF ENTRANT’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of a winner based on an Instagram account, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address registered with Instagram at time of entry. “Authorized Account Holder” is defined as the natural person 18 years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or each potential winner to provide Sponsor with proof that such party is the authorized account holder of the email account associated with the entry.
6. GENERAL: By entering this Challenge, entrants and each Winner: (1) agrees to be bound by these Official Rules; (2) agrees to release Sponsor from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Challenge, or the acceptance, possession, use or misuse of any prize and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery; and (3) consents to Sponsor’s use of his/her name, post, story, handle, voice, picture, and likeness for advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law, including any footage taken of a Winner during his/her visit to New York, and (4) acknowledge that Sponsor has neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose
7. LIABILITY & RELEASE: By participating in this Challenge, entrants agree to release and hold harmless Sponsor from and against any claim or cause of action arising out of participation in the Challenge or receipt or use of any prize hereunder, including, but not limited to: (a) unauthorized human intervention in the Challenge; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Challenge or the processing of entries; or (e) injury or death to a person(s) or damage to property which may be result, directly or indirectly, in whole or in part, from entrant’s participation in the Challenge or entrants’ receipt, acceptance, use and/or enjoyment of any prize. In no event shall Sponsor be liable for attorney’s fees. Each Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Sponsor reserves the right to correct typographic, clerical or printing errors in any Challenge materials. Sponsor is not responsible for any typographical or other error in the printing of this Challenge the administration of the Challenge or in the announcement of each Winner, including such error as may give an erroneous indication that a prize has been won. In the event the Sponsor is prevented from continuing with this Challenge, or the integrity and/or feasibility of the Challenge is undermined by any event including but not limited to virus, fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event) the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Challenge without notice or further obligation. If the Sponsor, in its discretion, elect to abbreviate, cancel or terminate the Challenge as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event.
8. USE OF INFORMATION: The information that you provide in connection with the Challenge may be used for Sponsor’s internal purposes and to send you information about Sponsor’s products and special promotions but will not be provided to other third parties, except as necessary for the administration of the Challenge, as required by law or legal process, or in accordance with Sponsor’s privacy policies. Entry constitutes permission to post name of each Winner on Sponsor’s Website and on Social Media, and to use each Winner’s name, hometown and/or likeness for purposes of advertising and promotion without notice and without further compensation unless prohibited by law. If you do not wish to receive information from Sponsor in the future, please make sure to unfollow Sponsor and/or unsubscribe from Sponsor’s emails.
9. NAME OF WINNERS: To obtain the name of a Winner (available after February 15, 2022) or a copy of the Official Rules, email giveaways@adoreme.com. Do not send Challenge entries to this address.
10: The terms of this Challenge are governed and interpreted pursuant to the laws of the State of New York, notwithstanding any principles of conflicts of law. Any disputes in connection with these terms that, results in court action, except for claims that are to be handled by a small claims court, shall be resolved exclusively by a state or federal court located in New York County, New York, and you specifically consent to the personal jurisdiction of such courts and waive any objection to the convenience of this forum.
